COCOA, Fla. – A 13-year-old was arrested this week after being accused of fatally shooting a man over the weekend.
In an arrest report, police said they were first tipped off to the shooting near Bristol Drive on Sunday night, just before 10:30 p.m.
Upon arrival at the scene, officers found a man — identified as Kelby Gavin Miller, 30 — who’d been shot in his torso, police added. Despite being airlifted to the hospital, Miller ultimately succumbed to his wound.

Afterward, though, detectives said they discovered that Miller had been communicating with a suspect via cell phone, though details about these messages were redacted in the report.
However, deputies said they later found surveillance footage that showed a “slim male” in a hoodie repeatedly walking to and from the shooting scene along A Street shortly before 10:30 p.m.
Eventually, detectives said they tracked the suspect to the home of 13-year-old Emeril Rachel, whose mother admitted to seeing similarities between her son and the person in the footage.
A detective was then escorted to Rachel’s bedroom, where they found a hoodie stained with blood and dirt markings, the latter of which matched a moment in the footage when the suspect was seen falling, the report states.

In addition, gunpowder was discovered on Rachel’s hand, though he denied every having a firearm, police said.
“Emeril did identify himself on the video and was shown still image photos of him before and after the victim was shot and killed,” the report reads.
As a result, Rachel now faces charges of manslaughter, and possession and use of a firearm during a felony.
