A lawsuit accusing the city of Deltona of taking actions that flooded homes in the Stone Island neighborhood in the wake of Hurricane Ian is over. A judge closed the case on Tuesday and granted summary judgment in the city’s favor.

The City of Deltona asked a federal judge to toss out a lawsuit claiming it was responsible for flooding in the Stone Island community after Hurricane Ian hit in 2022.

Don Phaneuf considers himself one of the lucky homeowners on Stone Island, a community on the north side of Lake Monroe near Deltona. Water came close to his home after Hurricane Ian, but never inside.

It's been nearly a month since Hurricane Ian hit, and some Volusia County communities are still underwater.
