ORANGE COUNTY, Fla. – A driver accused of DUI manslaughter in a crash that killed a 6-year-old boy will remain in jail while he awaits trial.
During a hearing on Friday, a judge heard arguments on a motion from prosecutors for pre-trial detention of Francisco Rosillo Arriola, 53.
Two Florida Highway Patrol troopers were brought to the stand where they testified about the condition of Arriola after the crash.
On Jan. 18, Emiliano Garcia was riding his bicycle along Tahoe Street near Apopka when troopers said Arriola ran a stop sign and struck him with his vehicle.
According to investigators, Arriola had blood-shot eyes, slurred speech and smelled of alcohol after the crash.
Records showed Arriola was given a breathalyzer test more than four hours after the crash and results showed a blood alcohol level between 0.075 and 0.078. The legal limit for alcohol in Florida is 0.08.
During Friday’s meeting, prosecutors also spoke about Arriola’s criminal history.
Arriola had two previous DUI arrests, including one in October where his driver’s license was revoked.
The troopers also say they confirmed that Garcia was an undocumented immigrant.
The state argued that Arriola’s past actions showed he has a disregard for the safety of the community.
The judge ruled in the state’s favor and decided hold Arriola without bond on his second count, which is DUI manslaughter.
