CBD and driving: Will you be charged with DUI?

ORLANDO, Fla. – News 6 traffic safety expert Trooper Steve Montiero answers viewer questions and shares tips about the rules of the road, helping Central Florida residents become better drivers by being better educated.

Mel on Tuesday asked, “Can you get charged for DUI after consuming CBD?”

Trooper Steve said there is a common misconception that when charged with driving under the influence, it is always pertaining to alcohol.

“I am here to tell you that is merely a poor assumption. You can be charged with driving under the influence if you are under the influence of anything that impairs your normal faculties. Normal faculties being your normal driving behavior,” he said.

Trooper Steve said this applies to anyone taking anything, even if a substance is legal or you have permission to use it.

“Using whatever substance, whether legal or not, and it impairs your driving would be considered driving under the influence,” he said.

He said there is also a common excuse when the terminology of “legal limit” is used.

“We often say the legal limit to drive is 0.08. However, even if your blood alcohol level is underneath 0.08 and your normal faculties are impaired, you are now driving under the influence,” he said.
