19-year-old indicted on murder charge 3 years after shooting in Volusia County

VOLUSIA COUNTY, Fla. – A man who was 15 years old when, according to deputies, he shot a man at a home in Oak Hill in 2019 has now been indicted on a charge of first-degree murder.

The indictment against James Powell, 19, was filed Tuesday and includes charges of aggravated battery and attempted first-degree murder in addition to a first-degree murder charge.

Powell originally surrendered to Daytona Beach police in February 2019 following the shooting of Joel Tatro, 45. The shooting occurred on East Church Street in Oak Hill, where authorities said a man was hosting a party for his children, who were in high school.

A confrontation arose when Powell and Sylvano Leslie II, who were not invited to the party, arrived and one of them refused to leave, records show. Deputies said Tatro was shot in the neck during the fight.

At the time of the shooting, Tatro was paralyzed from the neck down as a result, according to his family. According to the Daytona Beach News-Journal, Tatro died on March 7. The News-Journal reported Powell was out on bond at the time.

Powell faced an attempted murder charge following the 2019 shooting and that charge has been upgraded following Tatro’s death.

The 19-year-old was arrested again Wednesday and he is being held in the Volusia County jail on no bond.
