Jason Brzuszkiewicz, 49, says ‘he wanted to drive on the beach’

VOLUSIA COUNTY, Fla. – A 49-year-old man faces charges after he drove around a closed beach access gate Tuesday and took a drive in the ocean in Volusia County.

Deputies said they responded to New Smyrna Beach around 8:54 a.m. in response to a vehicle that drive around the closed gate that read “DO NOT ENTER” and onto the beach without paying the toll fee.

According to an arrest affidavit, a deputy witnessed 49-year-old Jason Brzuszkiewicz, walking away from a lifeguard who was on the scene in case there was a medical emergency.

Deputies said Brzuszkiewicz told them “he wanted to drive on the beach.”

According to the affidavit, deputies told Brzuszkiewicz that the beach was closed to traffic because of high tide and also explained that he failed to paid to pay the fee to access the beach.

Brzuszkiewicz was arrested and faces charges of failing to pay the access fee. He was transported to the Volusia County Branch Jail with a bond of $200. The vehicle was towed, deputies said.
